Tips for managing BCIPA disputes

 

  1. Act quickly.  BCIPA is designed to resolve disputes quickly so it is imperative that you follow the timelines specified in BCIPA.
  2. Make it easy for an adjudicator to understand your submissions.  Adjudicators have to get across a wide range of issues very quickly.  The easier you make this task the more likely they are going to clearly understand your case.
  3. Provide more information rather than less.  Ensuring all parties are aware of the facts increases your chance of resolving the issue quickly and will greatly assist in your preparation should you need to go to adjudication.
  4. Obtain expert reports to support your case.  If the payment claim is disputed, expert reports supporting your case can be invaluable.
  5. Get expert legal advice.  BCIPA can be a very effective tool for managing payments but it can be confusing.  Having assisted contractors, engineers, sub-contractors, suppliers, owners and building managers with claims from a few thousand to tens of millions of dollars, we can give you expert advice to help get the best outcome for your situation.
