Two more papers published!
Our principal Chris Lenz feels privileged in having 2 further papers published recently.
The first is Cross Border Construction Dispute Mediation: The Arbitrator and Mediator Journal June 2017, pages 28-41, which deals with the various cultural issues in a theoretical civil engineering construction dispute involving Australians, British and German protagonists, and how a mediator must recognise the influence of culture.
The second is Does Equity Undermine Construction Contracts’ Risk? Australian Construction Law Newsletter #175 July/August 2017 pages 44-51. It was a Commended paper in the General Division of the 2017 Brooking Prize of the Society of Construction Law Australia. It deals with whether Equity can overcome the harshness of contractual risk allocation using the principles of estoppel and penalties.
